1. Who we are
NovaCanva (the “Service”) is operated as an independent project by kingoy (the “Operator”). The Service is currently in free public beta. Features, pricing, branding, and availability may change without notice. Contact: hello@novacanva.com
2. Acceptance
By accessing or using NovaCanva you agree to be bound by these Terms. If you do not agree, do not use the Service. If you use NovaCanva on behalf of an organization, you confirm you have authority to bind that organization.
3. Account & eligibility
You may use the core editor without an account — your projects stay on your device (IndexedDB). Creating an account requires a valid email address. You must be at least 16 years old (or the minimum age of digital consent in your country — 13 in the US, 14-16 elsewhere in the EU). You are responsible for keeping your credentials secure and for activity on your account.
4. Your content
You retain full ownership of visuals you create, images you upload, and text you enter. You grant NovaCanva a limited, non-exclusive license to store and process your content solely to operate the Service. We do NOT claim ownership of your work and do NOT use your content to train AI models. You represent that your uploaded content does not infringe third-party rights. You are solely responsible for the legality of content you upload.
5. Proprietary license & ownership
The Service, including its generators, shaders, presets, UI, brand assets, and source code, is the exclusive property of kingoy. All rights reserved. No license is granted to copy, modify, decompile, reverse-engineer, redistribute, self-host, resell, or create derivative works of the Service or any part of it, except as strictly necessary to use it as intended via this app. You may freely use visuals you export for personal or commercial projects. You may not redistribute the engine itself.
6. Acceptable use
You agree not to: (a) upload illegal or infringing content, (b) attempt to reverse-engineer, scrape, or clone the Service, (c) abuse the infrastructure (excessive automation, DoS, export spam), (d) use the Service to produce hateful, defamatory, or illegal content, (e) misrepresent the Service as your own.
7. Beta status & warranties
The Service is provided “as is” and “as available” during the beta. We make no warranties, express or implied, regarding uptime, data retention, performance, accuracy, or fitness for any particular purpose. Features may be changed, removed, renamed, or made paid without notice. Exports saved locally (IndexedDB) may be lost if your browser clears storage.
8. Limitation of liability
To the maximum extent permitted by law, the Operator is not liable for any indirect, incidental, consequential, or punitive damages, loss of data, loss of profits, or business interruption arising from the use or inability to use the Service. Aggregate liability is capped at the greater of €50 or the amount you paid (if any) in the last 12 months.
9. Termination
You may delete your account at any time via Account → Settings. The Operator may suspend or terminate accounts that violate these Terms, with or without notice. Sections on intellectual property, limitation of liability, and governing law survive termination.
10. Governing law & disputes
These Terms are governed by French law. Any dispute will be submitted to the competent courts in France, unless mandatory consumer protection rules in your country require otherwise.
11. Changes
These Terms may be updated. Material changes will be surfaced in-app or by email. Continued use after a change means you accept the new Terms.
12. Miscellaneous
Severability: if any clause is found unenforceable, the rest remains in effect. Entire agreement: these Terms together with the Privacy Policy and Cookies Policy form the complete agreement. No waiver: failure to enforce any right is not a waiver. Contact: hello@novacanva.com
